Terms of service

1. The service

Cogpit connects you by live video or audio to another adult who chose a similar interest. It is provided as-is, free of charge unless you buy an optional paid tier. We may change, suspend or withdraw any part of it.

2. You must be 18 or older

Cogpit is an adult service. By starting a chat you confirm you are at least 18 and legally able to enter this agreement. Accounts and devices belonging to minors are banned on sight and, where the law requires it, reported.

3. Moderation and inspection (read this one)

Conversations on Cogpit are public-facing interactions with strangers, not private correspondence. By using Cogpit you consent to a Cogpit moderator inspecting or joining your conversation at any time, without prior notice, in order to verify compliance with these terms. Every inspection is recorded in an internal audit log. If you are not comfortable with that, do not use Cogpit.

4. Your device checks itself

While you are in a conversation, your own browser looks at the picture your camera is sending and makes a rough guess about whether it breaks the rules. It also looks at the picture you are being shown, for the same reason. You agree to both when you start.

No picture ever leaves your device because of this. The looking happens inside your browser, on frames that are already there; what reaches us is a number between nought and one and the conversation it came from. We could not do it any other way even if we wanted to, because conversations are encrypted directly between the two participants and our servers never see them.

It is a way of deciding where a moderator should look, never a decision on its own. It cannot ban you, it is not shown to the person you are talking to, and it is wrong often enough that everything it raises is checked by a person who can see the conversation. A close-up of a face looks much like anything else to it. A flag disappears the moment the conversation ends, and nothing about it is kept afterwards.

You may not disable, patch around or interfere with this check. Doing so is a breach of these terms in itself, whatever else you were doing at the time.

6. What a report keeps

When somebody reports you, we store the conversation id, the reason they gave, a salted fingerprint of your connection, one still picture showing both cameras, yours and theirs, side by side and the last four messages typed in that conversation, all taken at the instant the report was made. Both people are in that picture deliberately: judging one person on a frame that shows nothing of what they were responding to is not evidence, it is half a story. The messages are there because somebody with their camera switched off can still threaten a person, and a moderator judging that on a black rectangle is judging an accusation rather than evidence.

A report about a minor or about illegal content is different. There the picture is destroyed as soon as a moderator has decided the report, not after thirty days, and in any case within two days whether or not anybody has decided it. A picture of that kind can be unlawful to possess, and a retention rule written for evidence of rudeness has no business applying to it. If the matter goes to an authority, the copy that goes to them is the only copy that continues to exist.

Every other picture and the messages are deleted automatically after 30 days, and kept beyond that only where they have been handed to an authority. Nothing else about a conversation is stored: the video and the text are encrypted between the two participants and our servers never see them.

One further thing is kept, and only in three cases. If the report says you showed a minor, something otherwise illegal, or violence, and you are still connected at the moment it is made, we also keep the IP address of that connection. We do this because we may be obliged to report a crime, and a salted hash is useless to the police: only your internet provider can say who was using an address, only on a court order, and only if we can give them the exact time. No other report keeps an address, and if you have already disconnected there is nothing to keep: we do not go looking afterwards, because there is nowhere to look.

That address is encrypted where it is stored, it is opened only when a moderator prepares a referral, that opening is logged under their name, and it is destroyed once the referral has been made and in any case within 30 days. It is never used for advertising, profiling, matching, or for enforcing an ordinary ban.

6b. Translation

You can have what the other person types translated into your language. It is done by your own browser, on your own device, with models it downloads once. Nothing is sent to us to be translated, and we do not see the result any more than we see the original. A machine translation is a guess, so the words the other person actually typed stay one tap away and are what counts if a report is ever made about them.

7. Enforcement

We may end a chat, throttle you, or ban your device permanently, with or without notice. Serious matters, in particular anything involving minors or credible threats, are preserved and referred to law enforcement.

8. Your content

You keep every right you have in what you say and show. You grant us only the temporary technical licence needed to transmit it to the other participant and to let a moderator inspect it as described in section 3.

9. What other people do, and what we are answerable for

Everything you see on Cogpit comes from another person, live, and we do not see it first. There is no pre-screening and there cannot be: conversations are encrypted directly between the two participants. We do not select, edit, endorse or check what anybody shows or says, and we do not know what is on a camera until somebody tells us.

In law we are a hosting service for what our users transmit. We are not liable for that content provided we do not know it is unlawful and act promptly once we do – which is exactly what the report button, the moderator queue and the automatic suspension are for. If you see something wrong, report it; that is how the system is meant to work and how we are able to act at all. To the fullest extent the law allows, we are not liable for what another user says, shows, does or fails to do, for any loss, distress or harm arising from a conversation, or for anything you agree with another user privately.

The service is provided as it is and as it happens to be available. We give no warranty that it will be uninterrupted, error-free, secure against every attack, or that you will be matched with anybody in particular. To the fullest extent the law allows we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profit, lost data, or lost tokens. Where liability cannot lawfully be excluded, it is limited to what you actually paid us in the twelve months before the claim.

What we do not exclude, because it cannot be: liability for death or personal injury caused by our negligence, for fraud, for anything else the law does not permit us to limit, and any mandatory right you have as a consumer. Some of the limits above may not apply to you if you are a consumer in the EU, the UK or another country whose law says otherwise. Where a term in these conditions is found to be unenforceable, the rest still stands.

You are responsible for what you show and say, for having the right to show it, and for obeying the law where you are. If something you do costs us – a claim, a fine, a legal bill – you agree to cover it, so far as the law allows.

10. Removing people, and closing the door

We may suspend or remove any account, any connection and any person at any time, with or without notice, and without giving reasons in advance. We do it when the rules are broken, when we suspect they are about to be, when the law requires it, and when we judge it necessary to protect somebody. We do not have to prove a case first: this is a live video service and waiting is its own decision.

Nothing is paid out when that happens. Unspent tokens are not refunded, tokens recorded as received are not paid out, and a paid reinstatement does not survive a later ban. Where we are wrong you can appeal to a moderator, a person reads it, and we lift what we should not have imposed – but access to Cogpit is not something you have bought, and we do not owe it to you.

11. Paid tiers

Optional paid features are billed in advance and cancellable at any time; cancellation stops the next renewal. EU/UK consumers keep their statutory withdrawal rights.

12. Paying to lift a ban

Some bans can be lifted by paying a reinstatement fee. Which ones is not negotiable and not for sale: a ban that came from a report about a minor, about anything illegal, or about violence or self-harm can never be lifted by paying, whatever the amount. Those reports are decided by a person and, where the law requires it, referred to the authorities. An automatic pause is not chargeable either, because a moderator is already looking at it and most pauses are lifted on their own at no cost.

Where a fee does apply, it lifts that ban and nothing more. It is not a licence: breaking the rules again bans you again, and the fee is not refunded. Because reinstatement takes effect the moment the payment clears, it is fully performed digital content, so the statutory right of withdrawal ends at that point; you consent to that when you pay. We allow this only a limited number of times per connection, after which a ban stands.

Payment is handled by Stripe; we never see your card details. If a payment was taken and the ban was not lifted, write to a moderator with the receipt and we will refund it.

13. Tokens and gifts

Tokens are bought with money and spent on gifts inside a conversation. They are not money and they are not a deposit. They cannot be exchanged back, they have no value outside Cogpit, and once a gift has been sent it is not refundable. Unspent tokens do not expire.

Whoever receives a gift keeps a share of what it cost as tokens of their own, which they can spend on gifts like anyone else. Those tokens cannot currently be turned into money, we give no date for when they might be, and nothing here is a promise of income or of employment. If we ever do offer it, it will need identity checks and will be subject to tax rules, and the terms will be updated before it opens.

Buying tokens is a purchase of digital content that is delivered immediately, so the statutory right of withdrawal ends once they are in your account; you consent to that when you buy. If a payment was taken and the tokens did not arrive, write to write to a moderator and we will put it right.

Using a fault in the service to obtain tokens you did not pay for is a breach of these terms. We reconcile every balance against the payments and gifts behind it, and a balance we cannot account for is removed and the account may be closed.

Gifts are appreciation, never payment for anything. You may send one because you liked what somebody was doing: they played something, drew something, explained something, or were simply good company. Asking anyone to do anything in return for tokens is forbidden, and asking for anything sexual is forbidden absolutely, whether or not tokens are mentioned. That applies to asking, hinting, offering and agreeing, on both sides. A ban for it cannot be lifted by paying, and where the law requires it the conversation is referred on. See the rules.

14. When the service is not available

Cogpit is offered as it is, and we may pause it, change it, or close it down at any time, with or without notice. Paused means nobody can use it: not to chat, not to spend tokens, not to buy them. We do this to fix faults, to install updates, or because we have to.

A pause is not a refund. Tokens are not returned, converted or paid out while the service is down, and time lost is not compensated in tokens, money or anything else. Unspent tokens simply wait until it is back.

If we close Cogpit down for good, unspent tokens are not refunded and any balance shown as received is not paid out. We will say so in advance where we reasonably can, but we do not promise a notice period. This is the deal in return for tokens being cheap, having no expiry and requiring no account to buy: they are a way to use the service, not a claim on us. If you are not willing to lose what you have not spent, do not buy tokens.

None of this limits rights you have under mandatory consumer law, including for a payment that was taken but never delivered.

15. Law

These terms are governed by Swedish law and the courts of Sweden, without removing any protection you have under the mandatory consumer law of your own country.

Cogpit Pass

A pass removes the advertising slot and puts you first in the matching queue for the period you paid for. It buys nothing else: the rules, the reporting and the moderation are identical for everyone, and holding a pass has never prevented a ban. If you are banned, the pass is not refunded; that is the point of it not buying you anything.

The pass is stored in your own browser rather than in an account, so clearing your site data or switching device loses it. write to a moderator with your code or receipt and we will issue a replacement.

You may cancel within 14 days for a full refund, for any reason, by writing to the same address. This is the statutory right of withdrawal for consumers in the EU, and we do not ask you to waive it in exchange for immediate access.
